Single mother found guilty of murdering ex
Fiona Kinda - a single mother of a nine-year-old child - was last week found guilty of murder and is now awaiting sentencing by the Katutura Magistrate Court. Kinda has been convicted for murdering her estranged boyfriend and father of her child Charles Baisako. She will be sentenced this Thursday.
Magistrate Dinah Usiku said Kinda had acted with a direct intent to kill Baisako during a violent confrontation between the two. On June 15, 2008, Kinda fatally stabbed Baisako with a knife in the chest following an argument.
Kinda admitted that on the night of the incident - Baisako was on her premises - in contravention of a six months protection order against him. She said he first assaulted her by slapping her on her face.
According to Kinda, she did not have the intention to kill Baisako, but merely to scare him off the premises. Kinda admitted she acted in a negligent manner and unlawfully.
Baisako was allegedly dropped off at Kinda’s house in a drunken state by a friend, despite he being separated from her due to numerous altercations between them.
The estranged couple then started quarrelling with Kinda demanding to know why Baisako was dropped off at her house despite the protection order in place. Kinda then took Baisako’s cellphone and broke it prompting a neighbour to attempt to separate them.
However, the quarrel continued even after the neighbour managed to separate the two.
Kinda was still in the sitting room and behind burglar bars of the door when she stabbed Baisako with the knife. Baisako died on the spot.
Usiku said that it is her view that the stabbing of Baisako on the chest with a dangerous weapon carries such high incidences of serious and fatal injury, which reflects that she had direct intention to kill.
The post-mortem examination report indicates that the fourth left rib was ruptured, which shows that a lot of force was applied when inflicting the fatal wound, as Baisako and Kinda were separated by the burglar door,” Usiku said.
